Trial By Battle???

  1. This man is very knowledgable of ancient history, but foolish for attempting to bring this arguement to court. The elderly man should have thought more carefully of the defense he was bringing to court. With his knowing that such things as trial by battle were not allowed in our present day society, and his knowing that there would be a debate on the matter. The DVLA made the smarter choice by not allowing that act to be carried out with how childish the entire matter sounded. Allowing this trial by battle would cause unnecessary death to the true innocent people. Our societies have evolved with its people to protect the majority, to ensure humanity without violence, and over all bring us towards a new era. Evolution is key within every society, this man needed to realize this, because if he had he would not believe in the ancient ways, but learn to accept the new and improved laws placed.

  2. I think this story was hilarious and just proves that there are still outdated laws that are on the books. I honestly don’t think that this man was serious in the least bit. I feel he was upset and was looking for a way to prolong having to pay the fine, because he had to know that the courts weren’t going to go for this. When I read what the fine was for it kind of makes me wonder if he wasn’t trying to prove a point. He was no longer driving the motorcycle and was fined for failing to notify the Driver and Vehicle Licensing Agency of such. To me the law doesn’t make that much sense, especially if he isn’t driving the vehicle. I think this was his comical way of drawing attention to a law that doesn’t make a whole lot of sense and possibly needs to be changed. However he could have saved himself the extra money and just paid the fine the first time.

  3. I absolutely love how he has challenged the system! It may be slightly odd and a challenge to the death seems extreme but the fact that he is aware of this outdated law and the attention and probably embarrassment he was able to bring upon the DVLA was his intention from the beginning I believe. I just think that he was wanting to expose the flawed system in which he was under jurisdiction.

  4. I think this story is so funny, especially considering the fact that it was a minor fine. But this story definitely reiterates what we discussed in class the other day, how certain laws pertain to specific time periods and locations, and they may seem odd to us, but that's how it is. I guess in this case, the law wasn't exactly held true, but it still goes to show that there are so many parts of the law that are odd that we have no idea even exist. I think that the fact that he went through all the trouble of finding this ancient law should have set him free, if I were the judge, I would have just let him pass by, so maybe being a judge isn't the best job for me.

  5. I am quite sure that when Leon Humphreys attempted to get out of a simple £25 fine, it was all a joke. This as others have said showed the court how many laws are idiotic and absurd. In class the other day we talked about how you cannot have heels higher than three inches in Alabama. This is the same type of law that was great when the law began, but absurd in today’s society. It would be better if the laws were changed more frequently to stop the rather odd and interesting fines and or demands that come from these laws. Truly if this is still a law he should have been about to fight for it. Even when it is an outrageous challenge to even ask for. It definitely would have been interesting. (And been on YouTube ha ha) It might have been better to fight, but not to the death.

  6. This article made me laugh but at the same time I wonder what this man was thinking when he requested this. Did he honestly think that the court would grant his request to fight to the death over a simple traffic ticket? I remember talking about this in class and thought that this was so outdated, obviously I was wrong and there are still people who believe this should be enforced. I admire the man for trying to get out of his ticket in a very unique way, maybe he should have asked to be put in a barrel or maybe wear an iron maiden. Maybe he was truly innocent and felt God would protect him and prove his innocence or maybe he was simply trying to obtain the challenger’s property. I bet next time this guy gets a ticket for £ 25, he will pay it before he is fined £300 instead.

  7. I am going to take a wild guess, and argue that this man looks like the hulk, in human form, silly of him to want to fight to the death unless he can hold his own. This is, however, an interesting story in that this guy knows his history and was confident enough to challenge the system in his own way. It seems to me that somehow a challenge such as this would make the court suggest pleading temporary insanity before allowing someone to fight to their death. Furthermore, anyone who has any kind of common sense would know that during any time period a suggestion such as this one is silly. Trial by Battle proves absolutely nothing other than it provides a measure of strength and power by the winner. Someone stronger, who did the crime, may not due the time, because the person who was affected by the criminal, may be smaller or less capable in a battle scene.

  8. A fight to the death over a fine is one of the dumbest things you could possibly do. Your 60 years old no fighter or champion wants to fight an old man. Just pay the dam ticket. Not only did you make yourself look like an idiot you have to pay more. I am glad the court rejected it because that would have been a disaster. But to prevent this we really need to update some of those laws or just get rid of them before somebody else tries to fight to the death again.

  9. I cant believe this is still a choice for people. Is it right for the system to turn his offer down? Technically it still is a choice he can make by law. This request is a little over the top. His request was apparently taken as a joke and hopefully this law for trial by battle has been done away with. The man knew his law history and requested something that probably hadn’t been requested in years. This had to have stumped the judges\officers. This is not the only old ridiculous law forgotten in the books. If an old law is forgotten but not taken out of the books is it right to turn down a request like this one or not enforce the law?
